1. Acceptance of these Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Cruisy ("Cruisy," "we," "us," or "our"). By creating an account, downloading the app, accessing the website, or otherwise using any part of Cruisy, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use Cruisy. Your continued use of Cruisy after any changes to these Terms constitutes acceptance of those changes.
2. What Cruisy provides
Cruisy is a cruise companion application that helps users plan, organize, and remember cruise vacations. Features include trip management, document storage, packing checklists, reminders, group coordination, social sharing, passport history, and cruise stats. Cruisy is not a cruise line, travel agent, booking platform, insurance provider, or carrier of any kind. We do not sell or arrange transportation, accommodation, shore excursions, or travel insurance. Any trip details, cruise line information, port schedules, or itinerary data displayed in Cruisy are for personal organizational purposes only and do not constitute a reservation, booking confirmation, or guarantee of service from any cruise line or travel provider.
3. Accounts and eligibility
To use Cruisy you must create an account using a valid email address or a supported third-party authentication provider such as Apple or Google. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at team@trycruisy.com.
Cruisy is intended for users who are at least 13 years old. Users under the age of majority in their jurisdiction should use Cruisy only with the permission and supervision of a parent or legal guardian. By using Cruisy, you represent that you meet these age requirements. We reserve the right to suspend or terminate accounts if we have reason to believe they are held by users who do not meet eligibility requirements.
4. Your content and trip information
Cruisy allows you to add, store, and share content including trip details, cruise documents, photos, notes, packing lists, guest information, group data, reminders, and other materials ("User Content"). You retain full ownership of your User Content. By uploading or adding User Content to Cruisy, you grant Cruisy a limited, non-exclusive, royalty-free, worldwide license to host, store, process, display, transmit, and use that content solely as necessary to operate, maintain, and improve the Cruisy service for you and other users. This license does not permit Cruisy to sell your content or use it for advertising without your consent.
You are solely responsible for the accuracy, legality, and appropriateness of any content you submit. Do not upload sensitive personal information belonging to others without their consent. Do not store payment card numbers, social security numbers, or government identification numbers beyond what is necessary for your own personal trip records.
5. Acceptable use
You agree to use Cruisy only for lawful purposes and in a manner consistent with these Terms. You may not use Cruisy to violate any applicable local, state, national, or international law or regulation. You may not use Cruisy to infringe the intellectual property, privacy, or other rights of any person. You may not use Cruisy to harass, bully, threaten, defame, or abuse any individual. You may not upload or transmit viruses, malware, spyware, ransomware, or any other harmful or disruptive code. You may not attempt to gain unauthorized access to Cruisy systems, servers, networks, or accounts. You may not scrape, crawl, index, or systematically extract data from Cruisy without prior written permission. You may not reverse engineer, decompile, or disassemble any part of Cruisy that is not made available as open source. You may not impersonate another person, organization, or Cruisy itself. You may not use Cruisy in any way that could impair performance, availability, or security of the service for other users.
We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these standards, with or without advance notice depending on the severity of the conduct.
6. Travel information is not guaranteed
Cruisy may display cruise itineraries, port of call information, ship details, embarkation dates, weather context, and other travel-related data. This information is provided for personal planning and organizational convenience only. It may be inaccurate, outdated, incomplete, or not reflective of current conditions. Cruisy does not independently verify cruise line schedules, port authority rules, immigration or customs requirements, health documentation requirements, visa policies, or any other official travel information.
You must verify all critical travel, safety, boarding, health, immigration, and itinerary information directly with your cruise line, travel agent, port authority, embassy, or other official source before travel. Cruisy is not responsible for any consequences arising from reliance on information displayed in the app, including missed departures, denied boarding, or travel disruption.
7. Third-party services and integrations
Cruisy relies on third-party service providers to deliver its features. These may include authentication providers, cloud infrastructure, database services, object storage, push notification services, analytics platforms, email delivery services, mapping providers, and document processing tools. By using Cruisy, you acknowledge that your information may be transmitted to and processed by these providers. Cruisy takes reasonable steps to select reputable providers with appropriate security practices, but we cannot guarantee or control the practices of third parties.
Cruisy may link to or integrate with external websites, cruise line portals, or other third-party content. These links are provided for your convenience and do not constitute an endorsement. Cruisy is not responsible for the content, accuracy, privacy practices, or availability of any third-party site or service. Any interaction you have with third-party services is governed by their own terms and policies.
8. Intellectual property
Cruisy and its logos, designs, text, graphics, interface elements, feature names, and other content created by Cruisy are owned by or licensed to us and are protected by copyright, trademark, and other applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of Cruisy's proprietary content without express written permission. Feedback, suggestions, or ideas you share with us about Cruisy may be used by us without restriction or compensation.
9. Availability and changes
We work to keep Cruisy available and reliable, but we do not guarantee uninterrupted access. Cruisy may be temporarily unavailable due to maintenance, technical issues, third-party outages, or other factors beyond our reasonable control. We reserve the right to add, modify, suspend, or remove any feature or portion of Cruisy at any time. We may also update or replace these Terms as the product evolves. If we make material changes to these Terms, we will provide notice through the app, on the website, or via email where reasonably practicable. Continued use of Cruisy after such notice constitutes acceptance of the revised Terms.
10. No warranties
Cruisy is provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by applicable law, Cruisy expressly disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and uninterrupted or error-free operation. We do not warrant that Cruisy will meet your specific requirements or that any errors will be corrected. No advice or information, whether oral or written, obtained from Cruisy or through the service creates any warranty not expressly stated in these Terms.
11. Limitation of liability
To the fullest extent permitted by applicable law, Cruisy and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, travel disruptions, missed cruise departures, denied boarding, damage to devices, or the cost of substitute services, arising from or related to your use of or inability to use Cruisy, even if Cruisy has been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of certain damages, Cruisy's liability is limited to the maximum extent permitted by law. In all cases, Cruisy's total cumulative liability to you for any claims arising from or related to these Terms or your use of Cruisy will not exceed the greater of (a) the amount you paid Cruisy, if any, in the twelve months before the claim arose, or (b) one hundred US dollars ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Cruisy and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to your use of Cruisy, your User Content, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Cruisy is established, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or your use of Cruisy that cannot be resolved informally will be subject to binding arbitration conducted on an individual basis, except where prohibited by law. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
14. Account deletion
You may request deletion of your Cruisy account at any time through the account settings in the app or by contacting team@trycruisy.com. Upon a valid deletion request, we will delete or de-identify your personal information as described in our Privacy Policy. Certain information may be retained for a limited period where required by law, necessary for security or fraud prevention, needed to enforce agreements, or stored in system backups that cycle on a standard schedule. Deletion of your account will remove your access to all associated trip data, groups, and passport history.
15. General provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cruisy regarding your use of the service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. You may not assign your rights under these Terms without our prior written consent. Cruisy may assign its rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
